Purpose of the processing
The processing of personal data freely provided by you is aimed solely at:
a) execution of the contract;
b) fulfillment of obligations provided by laws connected to the contractual relationship;
c) contract management;
d) any external professional collaborations for the fulfillment of legal obligations;
e) protection of contractual rights;
f) carry out market research and statistical surveys;
g) marketing, advertising, commercial and promotional activities of events and/or initiatives organised directly by Nexim Italia or in collaboration with third parties, both through the sending of promotional material using traditional tools (e.g. paper mail and/or telephone calls with an operator), and via electronic communication (e.g. e-mail, text messages, Apps and Social Networks), subject to specific consent ;
h) ensure registration on the Site and the correct provision of the contents and services offered by Nexim Italia through the Site as well as execute the requests sent by the User;
i) evaluate the use of the site and its content;
j) improve the products and services offered by Nexim Italia.
The legal basis of the processing for the purposes of this information is the execution of the contract or, as the case may be, the execution of pre-contractual measures adopted at the request of the user or the express consent of the interested party pursuant to art. 6, paragraph 1, letter a) and b) EU Reg. 679/16.
Processing methods and recipients
Personal data will be processed in paper, computerized and telematic form and entered into the relevant databases which may be accessed by authorized and trained subjects under the authority of the Data Controller.
The subjects to whom Nexim Italia communicates the data act as external Data Processors designated directly by Nexim Italia (Data Processors) or as persons authorised to process the data under the direct authority of Nexim Italia (Sub-processors).

Your data may be communicated for the sole purposes listed above to public and/or private entities, natural and/or legal persons (Judicial Offices, Chambers of Commerce, Chambers and Labor Offices, etc.), if communication is necessary or functional to the correct fulfillment of obligations arising from the law, employees and/or collaborators of Nexim Italia srl, companies, consultants or professionals possibly in charge of the installation, maintenance, updating and, in general, management of Nexim Italia hardware and software or which Nexim Italia uses to provide its services, third parties or Internet providers in charge of sending documentation and/or information material, commercial partners of Nexim Italia, companies that carry out market research, to third-party companies and other entities that carry out outsourcing activities on behalf of the Data Controller. The data collected will be processed in compliance with the principles of lawfulness, transparency, correctness, confidentiality, relevance and non-excess.
Data retention period
The data provided will be retained in compliance with the provisions of art. 5, paragraph 1, letter e) of EU Regulation 679/16 for the entire duration of the contract. Personal data for the purposes referred to in point 2, letter g) of this information notice will also be retained for a maximum period of 3 (three) years from the date of collection of consent. The retention period is based and justified by the promotional need even after the date of registration of the data. Nexim Italia reserves the right, before the expiry of the term, to request the renewal of consent and/or the updating of the data.
In the event that the User objects to the processing of data for Marketing purposes and/or revokes consent to the processing for Marketing purposes, the data will no longer be processed for this purpose and will be retained only if other legal bases for processing remain.
Transfer of personal data to third countries outside the EU or to international organisations
Personal data will not be transferred to a third country or to an international organization outside the European Union. However, the Data Controller reserves the right to use cloud services, in which case, the service providers will be selected from those who provide adequate guarantees, as provided for in art.46 of the Regulation.

The processing operations connected to the web services of this site take place at the operational headquarters of the Data Controller located in 15057 Tortona (AL), Corso della Repubblica n. 8A and are handled only by technical personnel of the Office in charge of processing. If necessary, the data connected to the newsletter service may be processed by the personnel of the company in charge.

Rights of interested parties
In relation to the purposes of the processing, the exercise of the rights provided for by articles 15 and following of the GDPR is recognized, to be exercised at any time and in particular the right to:
Art. 15 – Right of access
The interested party has the right to obtain from the data controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and information regarding the processing.
Art. 16 – Right of rectification
The interested party has the right to obtain from the data controller the rectification of inaccurate personal data concerning him or her without undue delay. Taking into account the purposes of the processing, the interested party has the right to obtain the integration of incomplete personal data, including by providing a supplementary statement.
Art. 17 – Right to erasure (right to be forgotten)
The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay and the controller shall have the obligation to erase personal data without undue delay.
Art. 18 – Right to limit processing
The interested party has the right to obtain from the data controller the limitation of processing when one of the following hypotheses occurs:
a) the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data;
b) the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead;
c) although the data controller no longer needs them for the purposes of the processing, the personal data are required by the data subject for the establishment, exercise or defence of legal claims;
d) the data subject has objected to processing pursuant to Article 21, paragraph 1, pending verification whether the legitimate grounds of the controller override those of the data subject.
Art. 20 – Right to data portability
The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and shall have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided.
In exercising his or her right to data portability pursuant to paragraph 1, the data subject shall have the right to have the personal data transmitted directly from one controller to another, where technically feasible.
Art. 21 – Right to object
The data subject shall have the right to object at any time, on grounds relating to his or her particular situation, to processing of personal data concerning him or her which is based on Article 6, paragraph 1, letters e) or f), including profiling based on those provisions.
Art. 22 – Right not to be subjected to automated decision-making, including profiling
The data subject shall have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her.
Art. 7 – Right to Revoke Consent
Furthermore, pursuant to art. 7, paragraph 3 of the GDPR, the right to withdraw consent at any time is recognized; the withdrawal of consent does not affect the lawfulness of the processing based on consent before its withdrawal.

Complaint and Appeal to the Supervisory Authority

Data Security
Nexim Italia uses security measures suitable for preventing accidental loss of the user’s personal data, as well as their use or access by unauthorized parties, as well as their alteration or diffusion.
Nexim Italia has established procedures for managing any personal data breaches using appropriate protection technologies. In the event that a breach of users’ personal data is detected, Nexim Italia will take immediate action to communicate such breaches to the user and to the competent supervisory authorities in accordance with the General Data Protection Regulation (GDPR).
